The following Terms and Conditions of Sale govern the sale of products by Smart Moves, (“we” or “us”) to you by Smart Moves either directly or via the Smart Moves website (“the Website”). We are able to process orders for our products for delivery in NZ, Australia, North America, Europe, UK, Middle East, South East Asia and the South Pacific. Your use of the Website to purchase products or the receipt by us of your order indicates your agreement to follow and to be bound by these Terms and Conditions of Sale.

2.1 Subscriptions are 12 month minimum.

 

3. Prices

3.1 All prices listed on our website are in US Dollars and are inclusive of GST and any other sales tax. All prices are correct when published. Please note that we reserve the right to alter prices at any time for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

 

4. Payment Options

4.1 Visa, Mastercard, Paypal and direct payment.

 

5. Business Name on Card Holders Statement

5.1 When you buy from us, our full business name “Smart Moves” will appear on cardholder statements for any transactions through this website.

 

6. Website & Credit card Security

6.1 We want you to have a safe and secure shopping experience online. All payments via our site are processed using SSL (secure socket layer) protocol, whereby sensitive information is encrypted to protect your privacy.

 

7. Delivery & Delivery Charges

7.1 The products become your property and responsibility once they have been signed for at the time of delivery. If products are lost or damaged in transit, please contact us within seven business days. We will use this delivery information to make a claim against our courier company. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our courier company that delivery was not successful.

 

8. Delivery Period

8.1 We endeavour to ensure that orders will be dispatched within five (5) business days of the order being placed. You will receive an email that confirms that your order has been dispatched.

8.2 To ensure successful delivery please provide a delivery address where someone will be present during business hours to sign for the receipt of your package. You can track your order by entering the tracking number emailed to you in the dispatch email into the Courier Post site.

 

9. Disclaimer & Limitation of Liability

9.1 Our website is intended to provide information for people shopping for our products and accessing our services, including making purchases via our website. While we endeavour to supply accurate information on the site, errors and omissions may occur. We do not accept any liability, direct or indirect for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this Website. You are solely responsible for the actions you take in reliance on the content on, or access, through this site.

To the maximum extent permitted by New Zealand Law, Smart Moves makes no representations or warranties of any kind, express or implied, as to the products being sold to you including but not limited to implied warranties of merchantability, fitness for a particular purpose, and there are no warranties, express or implied, which extend beyond the description of the merchandise contained on our order confirmation. We will not be liable for any damages of any kind arising from the use of this Website, including but not limited to direct, indirect, incidental, punitive and consequential damages.

10.1 We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control.

16.1 These terms and conditions shall be governed by the laws of New Zealand. All legal proceedings arising out of or in connection with these Terms and Conditions of Sale shall be brought solely in the city of Christchurch, New Zealand.
